A former Denver, Colorado teacher and assistant principal at the Collegiate Academy in Littleton (K-12) school was sentenced in the Jefferson County, Colorado District Court to 5 years of community corrections through the Colorado Department of Corrections.  The Denver Post reports that, in addition to the 5 year community corrections sentence, the teacher received a intensive supervised probation term of 5 years to life for the felony sex crime conviction.

The teacher and student began a sexual relationship when the student was in the 7th grade.  Since the student was clearly under the age of 15 when this sexual relationship began, the teacher was originally charged with the more serious version of sex assault on a child by one in a position of trust, i.e., where the child is under the age of 15, the actor is at least 4 years older and in a position of trust in relation to the child.  The act of child molestation by a teacher in these circumstances is a class 3 felony in Denver and all Colorado jurisdictions and carries a mandatory prison sentence of 10 years with a potential maximum of up to the remainder of the defendant's life.  In this particular case, the teacher received a plea bargain that allowed her to plea guilty to the less severe version of sex assault on a child by one in a position of trust, i.e., where the child is under 18 years of age and the actor is in a position of trust in relation to the child.  Child molestation in this form does still carry very severe potential consequences, but does not require mandatory prison under Colorado law.  This particular teacher/defendant is very lucky that the Jefferson County District Attorney's Office was willing to give her the benefit of this plea bargain.

The sex assault criminal defense attorneys at Frankfurt & Trani, P.C. have handled a number of very similar cases and in some cases, have even achieved better results than that of this case.  Any form of sexual criminal charge under Colorado law, especially sex assault on a child, is very serious and requires legal representation.  A person facing this type of criminal charge should never attempt to represent themselves.
The Denver, Colorado District Attorney's Office has filed felony charges against a 17 year-old boy after the death of his 11 month old cousin on September 7th.  The teen has been charged with child abuse resulting in death.
It is alleged that the teen fell asleep while babysitting the toddler.  When he woke up, the toddler was unconscious in a bathtub full of water.  It is believed that the toddler drowned while the teen slept.

Child abuse resulting in death is a very serious felony in all Colorado counties.  If it the alleged actions of a defendant facing such a charge are found to be reckless or knowing, a conviction for child abuse resulting in death is a class 3 felony and is considered a crime of violence under Colorado law.  A conviction for this form of child abuse carries a mandatory prison sentence of 10 years with a possible maximum sentence of 32 years.
If the alleged actions of a defendant charged with child abuse resulting in death are found to be negligent, the charge is a class 4 felony and is not consider a crime of violence.  Still, this is a very serious felony and does carry a potential sentence of anywhere from 2-6 years in prison.

What should you or loved one is accused of child abuse when an accident has led to the death of a child in your care?  The most important thing that you must do is to retain a Denver, Colorado criminal defense attorney who is knowledgeable and experienced with such such cases.  You should do this before you agree to speak with any law enforcement officer.  When choosing your attorney, carefully consider the lawyer's knowledge of the law, his or her experience, and the compassion and understanding that he or she shows during the initial consultation.

On the Monday telecast of her show, Oprah Winfrey revealed that she is donating $1 million dollars to the Denver School of Science & Technology charter school.  The donation will help the school open three new campuses over the next ten years.  The announced donation was made during Winfrey's promotion of a documentary titled "Waiting for Superman".

"Waiting for Superman", a film by Davis Guggenheim who directed "An Inconvenient Truth", is about the nation's lagging education system.  The movie surveys  "drop-out factories" and "academic sinkholes" and dissects the system and its many problems.  Advocates for the film hope that it will evoke the same emotions for social change that the films "An Inconvenient Truth" and "The Cove" evoked.  Bill Kurtz, the Denver School of Science & Technology's chief executive says that "[t]he movie is going to strike a national conversation that needs to happen about the fact that we all need to do better to create high performing schools".

The Denver School of Science & Technology is a free, open-enrollment, public school.  It was founded in 2004 and currently has 728 students in grades, 6,7 and 9-12.  It is a liberal arts school with a focus on science and technology.  The goal of the school is to prepare all of its students for college.  With that goal in mind, the school requires that all students complete pre-calculus, five years of high school science, and complete an internship and a senior project for graduation.  The school was awarded a silver medal in the U.S. News and World Report's issue ranking the nation's top high schools.  The school's website,, provides the following statistics on the demographics of its students:

· 45% of DSST students are economically disadvantages
· 60% of DSST students are Hispanic, or African American
· 50% of DSST students are first generation college bound
· Most students enter DSST at least one grade level behind in math and English

The attorneys at Frankfurt & Trani, P.C. applaud Ms. Winfrey for her very generous donation to Denver, Colorado's public education.  We are a criminal defense and personal injury law firm providing service to clients in Denver as well as all other Colorado jurisdictions.
